BODYHACKER LTD is a company registered in England and Wales, company number [COMPANY NUMBER], registered office [REGISTERED OFFICE ADDRESS]. Our training studio is at 9 Shottery Brook, Stratford-upon-Avon CV37 9NR.

You can contact us on 07588 963005 or sweat@thebodyhacker.co.uk.

“You” and “your” means the person receiving the Services. By booking or paying for any Service you confirm that you have read and accept these Terms. Please read them carefully, in particular sections 5, 6, 8, 9 and 13.

2. Your health and safety

  1. Before your first session you must complete our health and lifestyle questionnaire honestly and in full. You can find it on our contact page.
  2. You must tell us before any session about any medical condition, injury, medication, pregnancy or change in your health that may affect your ability to exercise safely.
  3. Where your answers or circumstances suggest a risk, we may ask you to get written clearance from your GP or another medical professional before you start or continue training. We may postpone or decline sessions until we receive it.
  4. You must stop exercising and tell your trainer immediately if you feel pain, dizziness, chest discomfort, shortness of breath beyond normal exertion, or any other unusual symptom.
  5. You must not train under the influence of alcohol or drugs. We will end a session if we reasonably believe it is unsafe to continue.
  6. Our trainers are fitness professionals, not doctors, physiotherapists or registered dietitians. Our Services do not replace medical advice, diagnosis or treatment.

3. Booking and eligibility

  1. All new clients start with a consultation, where we agree your goals and the most suitable Service.
  2. A contract between you and us is formed when we confirm your booking in writing (including by email, text or WhatsApp) and we receive your payment.
  3. Our Services are for adults aged 18 and over. Clients aged 16 or 17 may train only with written consent from a parent or guardian.
  4. Session times are agreed in advance and are subject to availability. Regular time slots are not guaranteed unless we confirm them in writing.

4. Prices and payment

  1. Our current prices are shown on our personal training, group training and online coaching pages. All prices are in pounds sterling.
  2. Personal training sessions and packages are payable in full, in advance, before the first session of that package.
  3. Group training memberships are payable monthly in advance.
  4. We may change our prices from time to time. Any price change will not affect a package you have already paid for. For group memberships we will give you at least 30 days’ notice of a price increase, and you may cancel your membership before it takes effect.
  5. If a payment fails or is not made on time, we may suspend your sessions until the payment is received.

5. Personal training packages

  1. Each package includes the number of sessions and the time period stated when you buy it. Personal training sessions last 60 minutes.
  2. All sessions in a package must be used within the package time period. Sessions not used within that period expire and cannot be refunded or carried over, except as set out in section 5.4 and section 11.
  3. Packages are personal to you and cannot be shared or transferred to another person without our written agreement.
  4. If you cannot train for 7 days or more because of illness, injury or pregnancy, and you give us a medical note, we will pause your package for up to 4 weeks so you do not lose sessions.

6. Cancelling or moving a session

  1. You must give at least 48 hours’ notice to cancel or move a personal training session. You can do this by phone, text, WhatsApp or email.
  2. If you give less than 48 hours’ notice, or do not attend, the session is forfeited and will be charged or deducted from your package in full. This is because we reserve that time for you and cannot usually rebook it at short notice.
  3. If you arrive late, your session will still finish at the scheduled time and will be charged in full.
  4. If we need to cancel or move a session, we will give you as much notice as possible and offer you another time at no extra cost. If no suitable time can be found, the session will be credited back to your package or refunded.

7. Group training

  1. Group training sessions take place on the days and times published on our group training page. Groups are limited to a maximum of 9 people.
  2. Your membership entitles you to the number of sessions per week included in your plan. Missed group sessions cannot be carried over, refunded or exchanged for personal training.
  3. Group memberships run month to month. You can cancel at any time by telling us at least 7 days before your next payment date. Your membership will then end at the end of the month you have already paid for.
  4. We may occasionally need to change, combine or cancel a group session (for example, due to trainer illness or a bank holiday). Where we cancel a session and do not offer a replacement within the same month, we will credit you for it.

8. Your 14-day right to cancel

  1. When you buy a package or membership, you have a 14-day cooling-off period, starting on the day we confirm your booking, during which you can cancel for any reason. This applies whether you buy online, by phone or in person at the studio.
  2. To cancel, tell us clearly in writing (email, text or WhatsApp is fine) within the 14 days. For example: “I wish to cancel my contract for [package] bought on [date].”
  3. If you have asked us to start your sessions or programme during the 14 days, we will deduct a proportionate amount for the sessions and services already provided. We will refund the rest.
  4. We will make any refund within 14 days of receiving your cancellation, using the same payment method you used, unless we agree otherwise.

9. Cancelling a package or membership later

  1. After the 14-day cooling-off period, you can still cancel a pre-paid personal training package by telling us in writing.
  2. If you do, we will refund the value of your unused sessions, less a cancellation charge of 30% of that value. This covers the time already spent assessing you and designing and planning your programme, and the sessions we have reserved for you.
  3. The value of unused sessions is worked out by dividing the price you paid by the number of sessions in your package.
  4. Sessions that have already expired or been forfeited under sections 5 and 6 are not refundable.
  5. Group memberships are cancelled as set out in section 7.3.

10. If we cancel or end your training

  1. In the unlikely event that we are unable to continue your training, you will receive a full refund for any unused sessions.
  2. We may suspend or end the Services immediately, by notice to you, if you seriously or repeatedly break these Terms, behave in a threatening, abusive or unsafe way, or fail to pay. In that case we will refund any unused sessions, less any amount you owe us.

11. Illness, injury and events outside our control

  1. Section 5.4 explains how we pause your package if you are ill, injured or pregnant.
  2. We are not responsible for delays or failure to provide the Services caused by events outside our reasonable control, such as severe weather, power failure, flood or government restrictions. If this happens, we will contact you, rearrange your sessions or offer online sessions where possible. If the disruption lasts more than 4 weeks, you may cancel and receive a refund for any unused sessions.

12. Results and nutrition guidance

  1. We will provide the Services with reasonable care and skill. However, results depend on many factors outside our control, including your starting point, health, consistency, sleep, nutrition and lifestyle. We do not guarantee any specific result, such as a particular amount of weight loss.
  2. Results shown on our website and social media are achieved by individual clients and are not typical of every client. Individual results vary.
  3. Nutrition guidance is general advice to support healthy habits. It is not a medical diet or treatment for any medical condition. If you have a medical condition, eating disorder or food allergy, you must speak to your GP or a registered dietitian before making changes to your diet.

13. Our liability to you

  1. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Nothing in these Terms affects your statutory rights as a consumer.
  2. Exercise carries some risk of injury. You agree to follow your trainer’s instructions, use equipment only as shown, and tell us about any health issues as set out in section 2. We are not responsible for injury or loss caused by you not doing so, or by you exercising unsupervised.
  3. We are not responsible for loss or damage to personal belongings brought to the studio, unless caused by our negligence.
  4. We are only responsible for loss or damage that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. We are not liable for any business loss, such as loss of profit or business opportunity.
  5. Subject to section 13.1, our total liability to you in connection with the Services is limited to the total price you have paid for them.
  6. We hold professional indemnity and public liability insurance.

14. Studio rules

  1. Please wear suitable training clothes and clean trainers, and bring water.
  2. Please respect other clients, our equipment and the studio. You are responsible for any damage you cause deliberately or carelessly.
  3. Children, pets and guests may only attend sessions with our prior agreement.

15. Online coaching

  1. Online coaching includes the programme, guidance and check-ins described when you buy it. It does not include supervised sessions unless stated.
  2. You are responsible for training safely, using suitable equipment and space, and following the exercise instructions you are given. Section 2 applies to online clients in the same way as studio clients.
  3. Programmes, videos and documents we provide are for your personal use only and may not be shared, copied or resold.

16. Gift certificates

  1. Gift certificates are valid for 3 months from the date of purchase and must be used within that time.
  2. Gift certificates cannot be exchanged for cash. The recipient must complete the health and lifestyle questionnaire before their first session.

17. Your personal data, photos and testimonials

  1. We collect and use your personal information, including health information you give us, only to provide the Services safely, and we keep it secure in line with UK data protection law. Full details are in our privacy policy.
  2. We will only take photos or videos of you, or use your name, photos, measurements or testimonial in marketing, with your clear consent. You can withdraw your consent at any time by contacting us.

18. Complaints

  1. If you are unhappy with any part of our Services, please contact us at sweat@thebodyhacker.co.uk. We will acknowledge your complaint within 5 working days and aim to resolve it within 14 days.

19. Changes and general terms

  1. We may update these Terms from time to time, for example to reflect changes in the law or our Services. The version in force when you buy a package applies to that package. For ongoing group memberships we will give you at least 30 days’ notice of any significant change, and you may cancel before the change takes effect.
  2. If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue to apply.
  3. If we do not enforce any of our rights straight away, we can still enforce them later.
  4. These Terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
